A federal judge has struck down the Trump administration's $100,000 fee on new H-1B visas, ruling it an unauthorized tax. This decision, which contradicts an earlier court ruling, is a win for states and medical professionals who argued the fee impeded hiring essential workers, though the administration plans to appeal.

A federal judge in Boston has invalidated the Trump administration's controversial $100,000 fee for new H-1B visas, declaring it an unauthorized tax by Congress. This ruling, which contradicts an earlier federal court decision upholding the fee, brings relief to employers, students, and workers who faced significant financial hurdles. H-1B visas are crucial for high-skilled jobs, particularly in technology, and are heavily utilized by workers from India. States involved in the lawsuit, including Massachusetts, argued that the fee severely hampered their ability to recruit much-needed doctors, teachers, and university faculty, impacting vital sectors like education, healthcare, and academic research. Massachusetts Attorney General Andrea Joy Campbell hailed the decision as protecting the H-1B program's integrity and ensuring the ability to fill critical vacancies. Similarly, the American Medical Association's president, Bobby Mukkamala, called it "a victory for patients," emphasizing the role of international medical graduates in addressing physician shortages. However, the Department of Homeland Security strongly disagreed, labeling the ruling "blatant judicial activism" and defending the Trump administration's efforts to reform immigration for American citizens and workers. The White House has also expressed confidence that the order will be reversed on appeal, indicating a likely continuation of the legal battle across multiple federal circuits, as other lawsuits against the fee are ongoing.
